Toyota Recalls - Warning About Driving

Following the recall of many Toyotas, due to concerns over braking problems and sticking accelerators, Nick Freeman warns drivers not to drive the affected cars anywhere.

He suggests that you shouldn't even drive the car to the garage for repairs but should ask the dealer to collect it. "There is a chance that you could have an accident on the way to the dealership, even if that is very unlikely.  And if someone wants to ignore the advice to have the car inspected and they are involved in an accident, in my opinion they would probably be criminally liable."

"One of the questions that the police always ask when you have had an accident is: "Are you alleging a mechanical defect?"  The answer in this case would be: "Yes, my accelerator got jammed."  The police will ask: "Were you not aware of the recall?" and if you were aware then you have a criminal problem - Toyota would not be criminally liable."

"If someone has had an accident in the past involving one of these Toyotas then the case could be looked at again - although you would think that someone would know if their accelerator had jammed. But if you think the accelerator was the cause of an accident, speak to a lawyer or your insurers. You could have the right of appeal."
